“Scratch Me Mondays”

Scratch Card Promotion and Grand Prize Official Rules
 

1. ELIGIBILITY: JP Licks, Scratch Me Mondays ("Loyalty Game") is only open to legal residents of the contiguous U.S. who are physically located and residing therein and who are at least eighteen (18) years of age or older at time of entry. Void where prohibited or restricted by law. Employees, officers and directors of J.P. Licks and their respective parent companies, affiliates, subsidiaries, divisions, participating vendors, promotion or advertising agencies, or any other person or entity involved with the design, production, execution or distribution of the Loyalty Game, and their immediate families (parents, children or siblings, and spouses, whether or not the individual lives in the same household) and those living in the same household as such individuals (whether related or not) are not eligible to participate in the Loyalty Game. No purchase necessary to enter or win.  A purchase will not improve your chances of winning.  All federal, state, and local laws and regulations apply.

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and judge’s decisions, which are final and binding in all matters related to the Loyalty Game.  Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. GAME DESCRIPTION AND DETAILS:  Scratch Me Mondays is not a lottery and is not meant for gambling purposes.  The Loyalty Program is intended for J.P. Licks customers only.  Distribution is limited to one Scratch Card per customer per visit, while supplies last.

3.  TIMING: Scratch Me Monday begins Monday, July 7, 2008, and ends Monday, July 28, 2008 (the "Promotion Period.")  Scratch Cards will be handed out every Monday of July at each of 8 J.P. Licks locations.

4. PRIZES: Every scratch card is a winner.  All prizes must be redeemed by 10/31/08. One (1) Grand Prize winner will be awarded:

·             One floral arrangement per month for one year from Twig.

·             One $250 Cash Cow Card from J.P. Licks.

To enter for a chance to win the Grand Prize:  Visit www.jplicks.com and select the “Scratch Me Mondays” link during the Promotion Period one time only: Place your name and email address in the space provided and you will automatically be entered into the Scratch Me Monday, Loyalty Game Grand Prize Drawing and will receive a confirmation email message.

One may enter to win from 07/07/08 to 07/31/08 and winner will be drawn post completion of promotion. Subsequent entries through www.jplicks.com will be disqualified.  Once submitted, entries become the sole property of Grand Prize Sponsors (JP Licks and Twig) and will not be acknowledged or returned.

Enter through mail: Fill out self addressed stamped envelope containing an enclosure with entrant’s name, address and telephone number and mail to “Scratch Me Mondays” c/o J.P. Licks, P.O. Box 1810, Jamaica Plain, MA 02130. 

5. HOW TO REDEEM YOUR SCRATCH CARD PRIZE:  Every card is a winner.  All prizes must be redeemed by 10/31/08. Redemption instructions vary and are as follows:

A. ALL J.P. LICKS PRIZES

All J.P. Licks prizes may be redeemed at any J.P. Licks location. Cards must be presented at register in exchange for prize indicated on winning spots. Cannot be combined with other winning cards, offers or promotions.

B. CITY VIEW TROLLEYS

Winning ticket may be redeemed at City View Trolleys for 1 free admission with the purchase of 1 admission.  Monday through Friday only.  Weekends and holidays are excluded.  Cannot be combined with other promotions or offers.

C.  NEWBURY COMICS

Winning ticket will be presented at Newbury Comics (Ticket code #1083254).  Sale items excluded. No double discounts. Valid at store locations only.  May not be applied to previous purchases.  Cannot be combined with other promotions or offers.

D. BOSTON MOVIE TOURS

Call Boston Movie Tours to make a reservation for a future date on a Boston Movie Tour.  Winning ticket will be used as admission pass on reserved tour. Ticket is valid for only 1 free tour. Cannot be combined with any other promotions or offers.  

E. JILLIAN’S BOSTON

Winning ticket will be presented at Jillian’s in exchange for 1 free bowling game, based on availability. Tickets may be redeemed Sunday-Wednesday only. May not be redeemed on Boston Red Sox home game days.  Cannot be combined with any other promotions or offers.

F. LUCKY STRIKE LANES

Winning ticket will be presented at Lucky Strike Lane’s in exchange for 1 free game of bowling, based on availability.  Tickets may be redeemed Sunday-Wednesday only. May not be redeemed on Boston Red Sox home game days. Cannot be combined with any other promotions or offers.

G.  SPIKE’S JUNKYARD DOGS

Winning ticket will be presented at Spike’s Junkyard Dogs in exchange for 1 free hot dog.  May be redeemed at Boston stores only.  No monetary value.  Cannot be combined with any other promotions or offers.

H.  CRAZY DOUGH’S PIZZA

Winning ticket will be presented at Crazy Dough’s Pizza in exchange for 1 free slice of pizza.  Cannot be combined with any other promotions or offers.

I.  QDOBA MEXICAN GRILL

Winning ticket will be presented a Qdoba Mexican Grill in exchange for 1 free taco salad.  Cannot be combined with any other promotions or offers.

J. FRANKLIN PARK ZOO

Winning ticket will be redeemed at Franklin Park Zoo for 1 free admission with the purchase of 1 admission.  Cannot be combined with any other promotions or offers.

K.  NEW ENGLAND SPORTS MUSEUM

Winning ticket will be presented at New England Sports Museum at TD Banknorth Garden for 1 free admission.  Cannot be combined with any other promotions or offers.

L.  BODYSCAPES FITNESS

Winning ticket will be presented to BodyScapes Fitness in Brookline for 1 free month membership at BodyScapes Fitness’ Brookline location.  Cannot be combined with any other promotions or offers.

6. DRAWING AND NOTIFICATION OF GRAND PRIZE WINNER: A random drawing to award the Grand Prize will be conducted by J.P. Licks ("Loyalty Game Administrator") (whose decisions are final on all matters relating to this Loyalty Game) on 9.01.08 from among all eligible entries received during the Promotion Period.

All entries:  Winner will be notified by email or phone immediately. If a potential winner cannot be reached within a reasonable time period, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, the potential winner will be disqualified and an alternate potential winner may be selected at Sponsor's sole discretion.

Grand Prize Exclusions:

A. J.P. Licks

Winner of J.P. Licks Grand Prize will receive 1 Cash Cow Card valued at $250 which may be used at all J.P. Licks locations.  May not be exchanged for cash.  Cannot be combined with any other promotions or offers.

B.  TWIG

Winner of J.P. Licks Grand Prize will receive 1 Floral Arrangement per Month for 1 Year from Twig.  Prize may not be transferred out of state.  Cannot be combined with any other promotions or offers.

7. ODDS OF WINNING: Odds of winning depend on the number of eligible entries received during the Promotion Period. There is a limit of one prize per person. No cash alternative, substitution, assignment or transfer of prize permitted, unless prize becomes unavailable, in which case a prize of equal or greater value will be substituted by Sponsor at Sponsor's sole discretion. Any depictions of prizes are for illustrative purposes only. Insurance, taxes, all costs, expenses and incidentals not mentioned above are the responsibility of winner. 

8. GENERAL LOYALTY GAME CONDITIONS: Loyalty Game is subject to these Official Rules and all federal, state, and local laws (collectively "Rules and Laws"). Potential winners may be required to sign and have notarized and return an Affidavit of Eligibility/Liability Release and any other documentation that Sponsor requires (and where legally permissible a Publicity Release) within seven (7) days of notification date or such winner will be disqualified and Sponsor reserves the right to randomly select an alternate winner.  If a winner is a resident of a state that deems him/her to be a minor, prize will be awarded in the name of his/her parent/legal guardian, who must also sign Affidavit/Release on his/her behalf. By returning the completed Affidavit/Release, winner attests to the authenticity of his/her winning entry.  Winners consent to use of their name and likeness for advertising/publicity purposes without additional compensation or permission, except where prohibited by law. Entrants hereby release, discharge and hold harmless J.P. Licks and their respective subsidiaries, related entities, affiliates, agencies, employees, officers, directors, shareholders and agents from any and all claims, demands, losses, injuries, deaths, expenses or other liabilities, either at law or in equity, whether known or unknown, arising out of participation in this Loyalty Game or any portion thereof, or the acceptance, possession, use or misuse of the prizes awarded hereunder. Sponsor assumes no liability or responsibility for damages, losses or injury resulting from participation in this Loyalty Game or any portion thereof, or the acceptance, possession, or use/misuse of the prizes.   All entrants and/or Winners agree that United States law shall apply exclusively to the Loyalty Game and that any dispute with respect to the Loyalty Game shall be resolved in either the federal or state courts located in the Commonwealth of Massachusetts.

Sponsor is not responsible for any typographical or other errors in the printing, the offering or the announcement of prizes.  Sponsor is neither responsible for late, incomplete or illegible entries or mail, nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems, transmission problems or traffic congestion on the Internet, at any website, in connection with any wireless transmission or any combination thereof.  No mechanical reproduction of entries accepted. Mass entries, or entries generated by a script, macro or use of automated devices will be disqualified. Entrant is responsible for all on-line charges/fees incurred by it with any Internet Service Provider and or wireless carrier. Entry materials that have been tampered with or altered are void. If the Sponsor and/or Loyalty Game Administrator determine, in their sole discretion, that there is any suspected or actual tampering with the Loyalty Game or if technical difficulties compromise the integrity of the Loyalty Game, the Sponsor and/or Loyalty Game Administrator reserve the right to void the entries at issue and/or terminate or modify the Loyalty Game and/or conduct a random drawing to award the prizes using all eligible entries received as of the termination date. If the Loyalty Game is terminated due to tampering or technical difficulties prior to the expiration date of the Promotion Period, notice will be posted at www.jplicks.com. Any attempt to deliberately damage the content or operation of this Loyalty Game is unlawful and subject to legal action. Entries made by any other individual or entity and/or originating at any other Internet website or e-mail address, including but not limited to commercial Loyalty Game subscription notification and/or entering service sites, will be declared invalid and as such ruled ineligible for this Loyalty Game.

 10. LEGAL DISCLAIMER: Any reference to the $1 billion dollar prize found on any J.P. Licks Scratch Me Mondays Loyalty Game cards are intended for entertainment and humorous purposes only. A second, matching $1 billion prize spot has not been printed on any scratch card and will not be awarded as a prize.
